Stop Your Personal Data from Being Shared or Misused

Terminated your timeshare agreement? Don't forget about your personal data.

Terminating your timeshare agreement and requesting the deletion of your personal data from a company's database are two distinct legal actions.

Why Deleting Your Data Is Important

Even after you terminate a timeshare agreement, the company may still hold your personal data, including your name, contact details, financial information and other records.

Requesting deletion, where legally applicable, is important for several reasons:

  • It's Your Legal Right (GDPR): Under Article 17 of the General Data Protection Regulation (GDPR), also known as the "right to be forgotten", you may request the erasure of your personal data when it is no longer necessary for the purpose for which it was collected, or when another applicable legal ground for erasure exists.

  • It Helps Prevent Future Misuse: Personal data may continue to be used for marketing or shared with third parties where a lawful basis exists. Reviewing how your information is handled and exercising your data protection rights can help reduce unwanted contact and potential exposure to scams.

  • It Enforces the Storage Limitation Principle: GDPR requires personal data to be kept no longer than necessary for the purposes for which it is processed. Once your contract has ended, information that is no longer needed and has no other valid legal basis for retention should be deleted.

  • It Gives You Control: Your personal information has value. Exercising your GDPR rights helps you understand how your data is being used and challenge processing that is no longer justified.

Termination vs. Data Deletion: What's the Difference?

Terminating a timeshare agreement ends the contractual relationship according to the applicable contractual terms and legal requirements. Data deletion, however, concerns the personal information the company continues to hold about you.

These are two separate matters.

  • Termination Does Not Mean Automatic Deletion: Ending a contract does not automatically remove your personal information from a company's systems. Certain records may still need to be retained for accounting, tax, regulatory or legal purposes. However, the company must have a valid legal basis for continued processing and comply with applicable data protection requirements.

  • Your Data Protection Rights May Require Separate Action: If your timeshare agreement has ended but your personal information is still being retained or processed, you may have grounds to request its deletion.

  • The "Right to Be Forgotten" Is Not Absolute: A company may be entitled or legally required to retain certain information, particularly where it is necessary to comply with legal obligations or to establish, exercise or defend legal claims.

Take Control of Your Personal Information

Ending your timeshare agreement is one step. Understanding what happens to your personal data afterwards is another.

Your personal information should not be retained or processed without a valid legal basis.

At European Contract Exit, we believe that transparency, proper documentation and awareness of your legal rights are essential throughout the contract termination process.
